Welcome to Lesonia Residency. These Terms and Conditions govern your use of our website and the purchase or reservation of apartments at Lesonia Residency. By accessing our website, scheduling a viewing, or expressing interest in purchasing an apartment, you agree to be bound by these terms.

Please read these terms carefully before making a purchase or reservation. If you do not agree with any part of these terms, please do not use our services or proceed with a purchase.

2. About Us

Lesonia Residency is a real estate development company operating in Kenya. We develop and sell premium off-plan residential apartments in Kileleshwa, Nairobi. Lesonia Residency offers 1, 2, and 3 bedroom apartments with world-class amenities and flexible payment plans.

3. Property Sales and Reservations

3.1 Property Description

Lesonia Residency offers premium off-plan residential apartments including:

  • 1, 2, and 3 bedroom apartment units
  • Modern architectural design and finishes
  • World-class amenities (swimming pool, gym, rooftop lounge, etc.)
  • Prime location in Kileleshwa, Nairobi
  • Expected completion: December 2028

3.2 Unit Availability and Reservations

  • Unit availability is subject to prior sale and is on a first-come, first-served basis
  • Reservations require a deposit payment as specified in the payment plan
  • Reservations are subject to availability and our approval
  • We reserve the right to withdraw units from sale at any time
  • Unit specifications and finishes are subject to change as per construction requirements

4. Pricing and Payment Plans

4.1 Unit Pricing

  • Unit prices are as displayed on our website and marketing materials
  • Prices are quoted in Kenyan Shillings (KES) and are inclusive of VAT where applicable
  • Prices are subject to change without prior notice for new reservations
  • Final pricing will be confirmed in the Sale and Purchase Agreement
  • Prices are locked in once a reservation deposit is paid and the Sale and Purchase Agreement is signed

4.2 Payment Plans

  • We offer flexible payment plans starting from a 20% deposit
  • Payment schedules will be detailed in your Sale and Purchase Agreement
  • Payment plans may include construction-linked payments or post-completion payment options
  • All payments must be made according to the agreed schedule
  • Late payments may incur penalties as specified in the Sale and Purchase Agreement

5. Payment Terms

5.1 Payment Schedule

  • Reservation Deposit: A deposit (minimum 20% of unit price) is required to reserve a unit
  • Progress Payments: Additional payments may be required at construction milestones as per the payment plan
  • Final Payment: Remaining balance is due upon completion and handover of the unit
  • Payment terms will be specified in your Sale and Purchase Agreement
  • All payments must be made in Kenyan Shillings (KES)

5.2 Payment Methods

  • We accept M-Pesa, bank transfer, or cheque payments
  • Payment details will be provided upon reservation
  • Reservations are not confirmed until the deposit payment is received and cleared
  • All payments must be made to our official accounts as specified in the Sale and Purchase Agreement

6. Buyer Responsibilities

As a buyer, you agree to:

  • Provide accurate personal and financial information for the purchase process
  • Make payments according to the agreed payment schedule
  • Complete all required documentation for the property purchase
  • Obtain necessary financing approvals if purchasing with a mortgage
  • Attend scheduled viewings and site visits during construction
  • Comply with all legal and regulatory requirements for property purchase in Kenya
  • Take possession of the unit upon completion and handover

7. Construction and Completion

7.1 Construction Timeline

  • Lesonia Residency is scheduled for completion in December 2028
  • Construction timelines are estimates and may be subject to delays due to unforeseen circumstances
  • We will provide regular updates on construction progress
  • Delays caused by factors beyond our control (e.g., weather, regulatory approvals, force majeure) do not constitute a breach of contract

7.2 Unit Specifications

  • Unit specifications, finishes, and amenities are as described in marketing materials and the Sale and Purchase Agreement
  • We reserve the right to make minor modifications to specifications for construction or regulatory reasons
  • Any significant changes will be communicated to buyers in advance
  • Final unit specifications will be confirmed during the handover process

8. Handover and Possession

  • Handover of completed units will occur upon completion of construction and receipt of all outstanding payments
  • Buyers will be notified in advance of the handover date
  • Buyers must complete a pre-handover inspection and sign acceptance documents
  • Any defects or issues identified during inspection will be addressed before final handover
  • Possession of the unit will be granted upon completion of all documentation and payment obligations

9. Title and Ownership

  • Title to the property will be transferred to the buyer upon completion of all payments and fulfillment of all obligations
  • We will facilitate the transfer of title and registration with relevant authorities
  • All costs related to title transfer and registration will be as specified in the Sale and Purchase Agreement
  • Buyers will receive all necessary documentation for property registration
  • Ownership is subject to compliance with all legal and regulatory requirements

10. Financing and Mortgages

  • Buyers may obtain financing from financial institutions to purchase units
  • We may provide information about financing options but are not responsible for mortgage approvals
  • Mortgage applications and approvals are the sole responsibility of the buyer
  • We will cooperate with financial institutions to facilitate mortgage processes
  • Buyers must inform us of any financing arrangements that may affect payment schedules

11. Cancellation and Refunds

11.1 Buyer Cancellation

  • Cancellation policies will be detailed in the Sale and Purchase Agreement
  • If you cancel before signing the Sale and Purchase Agreement, the reservation deposit may be refundable minus administrative costs
  • If you cancel after signing the Sale and Purchase Agreement, cancellation terms as specified in the agreement will apply
  • Refunds, if applicable, will be processed according to the terms in the Sale and Purchase Agreement
  • No refunds are provided for units that have been completed and handed over

11.2 Our Cancellation

  • We reserve the right to cancel a reservation due to non-payment, breach of agreement, or other reasonable circumstances
  • In such cases, refunds will be processed according to the terms in the Sale and Purchase Agreement
  • If we are unable to complete the development, buyers will be entitled to refunds as per the agreement terms

12. Limitation of Liability

  • Our liability is limited to the purchase price of the unit
  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for delays caused by factors beyond our control (force majeure, regulatory delays, etc.)
  • Buyers are advised to obtain appropriate property insurance
  • We are not liable for changes in property values or market conditions

13. Warranty and Defects

  • We provide a structural warranty as per Kenyan building regulations
  • Defects identified during the warranty period will be rectified at our expense
  • Warranty terms will be detailed in the Sale and Purchase Agreement
  • Warranty does not cover damage due to misuse, modifications, or normal wear and tear
  • Buyers must report defects within the specified warranty period

14. Dispute Resolution

In case of any disputes:

  • Contact our team first to resolve the issue amicably
  • If unresolved, disputes will be handled through mediation
  • These terms are governed by the laws of Kenya
  • Courts in Nairobi, Kenya shall have jurisdiction

15. Changes to Terms

We reserve the right to modify these terms at any time. Changes will be posted on this page. Continued use of our services after changes constitutes acceptance of the new terms. Existing projects will continue under the terms agreed at project commencement.
